Prohibition of Alcohol Beverages Sales to Those Below the Legal Drinking Age of 21 Years Old

As per the Food Act 1983, it is illegal for us to sell alcohol beverages to you if you are under the age of 21. It is illegal for you to buy alcohol beverages from us if you are under the age of 21 and it is illegal if you falsify your details in order to buy alcohol beverages if you are under the age of 21. Our delivery team reserves the right to request for your Identity Card/Passport for age verification purposes prior to delivery of goods. If found to be aged below 21, we reserve the right for cancellation of your order and the amount will be fully refunded.

Non-Sales of Alcohol Beverages to Muslims

By virtue of Section 19 (1) and Section 19 (2) Syariah Criminal Offences Act 1997, all Malaysian Muslims are forbidden from buying and drinking alcohol.

In accordance to the legal provisions above, City Cellar will not sell any alcohol products listed on its
website to any Malaysian Muslims.

Our delivery team reserves the right to request for your Identity Card for verification purposes prior to delivery of goods. If found to be a Malaysian Muslim, we reserve the right for cancellation of your order and the amount will be fully refunded.

Pricing, Orders & Payment

City Cellar reserves the right to alter prices at any time. All prices quoted are in Ringgit Malaysia (RM). We endeavor to supply advertised vintages, quantities and pricing, but all orders are subject to stock availability and confirmation by us. If any product ordered is unavailable or incorrectly priced, we will contact and advise you of the correct price, vintage or recommend a suitable substitute. All goods remain the property of City Cellar until payment made has been confirmed. We reserve the right to limit any sale.

Delivery Charge

Delivery will be charged according to the order value.
Free delivery for orders above RM 350 within Klang Valley (selected areas).
RM 10 delivery fee will be charged for orders under RM 350 within Klang Valley (selected areas).

Refund & Return

Discounted items are final and cannot be returned or exchanged. Normal priced items can be exchanged within 7 days from the delivery date. All orders are non-cancellable. 

Damaged/ Incorrect Items

Customers should reject outright during the delivery on any over/short supply, incorrect or damaged item (including but not limited to any visible defect of the item or any item has passed its expiry date) once the item has been received, customer is barred from bringing any claim in any nature whatsoever against us. Exception to this clause will be those non-visible defects i.e, corked wine where the opened bottle is required to be returned to the Company within three (3) Business Days from the item received date and the Company has seven (7) Business Days upon receipt of such notification by customer to verify and replace any defective wine item if necessary or refund the money at the sole discretion of the Company.

Product’s description and information

Please note that all product’s description and information may not be 100% accurate. For example, tasting notes and alcohol by volume (ABV%) may vary depends on vintage and sommelier’s experience and knowledge or personal preferences. Furthermore, the product’s image may not be absolutely accurate as well due to changing label or packaging by producers. Do not worry if you received a product which does not match with the image on our website. However, if you do have any doubts regarding the product, do not hesitate to contact us immediately.

Product’s Stock Level

For Bulk Order

For bulk ordering (usually more than 6 bottles and above) please check with us before making any payment to avoid any insufficient stock. If order had been made while there is insufficient stock, full refund will be made on the short order fulfilment or you can wait till the stock arrives, estimated time of arrival will be advised.

Single Product Order

Due to occasional high order demands, products on our website will be out of stock without any prior notification. However, full refund will be made if that particular product is out of stock, no charges will incur or you can wait till the stock arrives, estimated time of arrival will be advised.

Product’s Vintage / Alcohol Content

Please take note that product’s vintage & alcohol content will be changed without prior notification due to product’s batches. Vintage / Alcohol content shown in product details might be outdated. Please inform/contact City Cellar to check specific vintage availability.

Pricing Information

We make every effort to correctly display our prices on the website. However, if an item’s price is incorrect, we reserve the right to not proceed with your order at that incorrect price. We will contact you to give the option of paying the correct price or refund the items involved. Prices shown against each item listed are not inclusive of postage and packaging which will be added to the bill, where applicable.

Advertisements

City Cellar endeavors to provide current and accurate information in respect of current promotions and “on sale” or “flyer” items on the Website. However, misprints, errors, inaccuracies, omissions (including incorrect specifications of products) or other errors may occur sometimes. 

City Cellar reserves the right to: (a) correct any error, inaccuracy or omission at any time without prior notice or liability to you or any other person; and (b) change at any time the products on the Website, the prices, fees, charges and specifications of such products and services, any promotional offers and any other Website content without any notice or liability to you or any other person.

Indemnification

You agree to indemnify and hold harmless City Cellar, the parent company, its officers, directors, employees, consultants, representatives and agents from and against any claim, cause of action or demand, including without limitation reasonable legal, accounting and other professional fees, arises as a result of your use of the website.

Governing Law

This Agreement and its performance shall be governed by the laws of Malaysia. You consent and submit to the exclusive jurisdiction of the courts and administrative tribunals, as the case may be, located in the Kuala Lumpur, Malaysia, in all disputes arising out of or relating to the use of the website and these Terms and Conditions.

Severability

These Terms and Conditions shall be deemed severable. In the event that any provision is determined to be unenforceable or invalid, such provision shall nonetheless be enforced to the fullest extent permitted by applicable law, and such determination shall not affect the validity and enforceability of any other remaining provisions.

Headings

The headings used in these Terms and Conditions are included for convenience only and will not limit or otherwise affect these Terms and Conditions.

Entire Agreement

These Terms and Conditions, together with those incorporated or referred to herein, constitute the entire agreement between us relating to the subject matter hereof, and supersede any prior understandings or agreements (whether electronic, oral or written) regarding the subject matter, and may not be amended or modified except in writing, or by City Cellar making such amendments or modifications available to it pursuant to the Terms and Conditions.
